• You consent to receive recurring automated and non-automated text messages at the phone number you provide.

• Message frequency varies. Message and data rates may apply.
• Consent to receive SMS messages is not a condition of purchasing any goods or services from us.

5. SMS Opt-In and Opt-Out

Opt-Out: You may revoke your consent and opt out of SMS messages at any time by:

• Replying STOP to any text message received from us.

After opting out, you will receive a confirmation message, and no further SMS messages will be sent to that number unless you re-subscribe. Opting out of SMS does not affect communications through other channels.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEN ABRAHAM / MOUNT CONTROL LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
• ANY CONTENT OBTAINED FROM THE SERVICES;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Ben Abraham / Mount Control LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Miami-Dade County, Florida.

We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated effective date. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of the changes.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ben Abraham / Mount Control LLC regarding the use of the Services and supersede all prior agreements and understandings.
